Residency Requirements
Before starting the process of getting a divorce in New York there are requirements related to residency that must be met. To pursue a divorce case in a New York court at least one of the following conditions needs to be fulfilled;
- Either spouse must have been living in New York State continuously for a minimum of two years before filing for divorce.
- One spouse should have resided in New York State for at least one year before filing for divorce and either the marriage took place in New York or the couple lived together in New York as a married couple.
- One spouse must have lived in New York State for one year and the reasons leading to the divorce should have occurred within New York.
- Both spouses were residents of New York at the time of filing for divorce and the reasons, behind seeking a divorce happened within the state.
In New York, couples who want a divorce can choose between a no-fault divorce and a fault-based divorce.
A no-fault divorce is based because the marriage has been irretrievably broken for six months before filing for divorce. This means that the couple believes their marriage cannot be repaired or reconciled.
Alternatively, spouses can pursue a fault-based divorce by citing reasons such as:
- Inhuman treatment
- Abandonment
- Imprisonment
- Adultery
- Living separately according to a separation judgment or agreement.
